Our Business Package is only
supplied on Licence, it is not for ‘sale’, it is not ‘sold’ and we do
not ‘sell’ it. The Licence Agreement appears below. Placing your order
implies acceptance of the terms.
LICENCE
AGREEMENT
In this agreement 'the licensor'
means Georgina Harris and 'the licensee' means the person or persons
placing the order.
Grant: On payment of the current fee the licensor grants to the licensee a
personal, non-exclusive Licence to use the materials and support as described
herein.
Duration: Provided the licensee conforms to the conditions of this Licence, its
grant will be ongoing, and the licensee may retain the materials indefinitely.
The Licence is neither saleable nor transferable.
Fees: Other than the initial payment, no further payments shall be due to the
licensor by the licensee.
Delivery: Upon payment of the current fee all materials as described (operating
manuals, documentation, software) will be delivered by the licensor to the
licensee, and the support elements as described (support line, update services)
made available to the licensee.
Ownership: The materials supplied will at all times remain the property of the
licensor.
Permitted use: All materials and information provided may be used solely by the
licensee in connection with their own Cash Loan Personal Credit Business.
Confidentiality: The licensee agrees to keep confidential and not disclose to
any third party not connected with their own Cash Loan Personal Credit Business,
all information, working methods, techniques, trade secrets and systems that are
learned through the operating manual, documentation, software, support line, and
update services, supplied by the licensor.
Separate entity: Any business that the licensee sets up will be a separate legal
entity to the licensor. The trading name must not include any
wording that could be interpreted as associating itself with any trading name of
the licensor.
No selling: Under no circumstances or at any time may the licensee sell or
advertise for sale all or any of the licensor's material.
Termination: In the event that the licensee infringes any of the conditions of
this Licence it may be revoked, whereupon all materials supplied must be
immediately returned to the licensor.
Copyright: All material supplied is protected by copyright. No person or persons
may copy, reproduce, transmit or distribute any of the material supplied without
the licensor's express written permission.
Disclaimer: Whilst all reasonable care has been and will be taken to ensure the
accuracy and adequacy of the material supplied, and the information and material
provided from time to time, no responsibility will be accepted by the licensor
for any loss occasioned to any person as a result of any material or information
provided.
Damages: The licensee acknowledges that breach of any of the conditions of this
Licence may be commercially harmful to the licensor, and that in the event of
any such breach or alleged breach the licensor will be entitled to apply for
injunctive relief and to claim for damages.
Failure to enforce: If the licensor fails to enforce any provision of this
Licence, that failure will not preclude them from enforcing either that
provision or any similar provision on a later occasion.
Applicable law: To the extent possible under applicable law, this Licence
Agreement shall be governed by the laws of England and Wales and shall be
subject to the non-exclusive jurisdiction of the English courts.
